What Indiana's Written Buyer Agreement Means If You're Touring in Crown Point

You can browse Crown Point listings all morning. You can call the shop with a real question. The paper comes out before we walk into an MLS home together, including a virtual tour. That is Indiana law plus how REALTORS have to work the MLS. It is not a trap to buy a house this week.

What changed, in shop words
On July 1, 2024, Indiana required licensed brokers to put a buyer relationship in writing. The statute is Indiana Code 25-34.1-12-2. The agreement has to show a definite expiration date. One copy goes to you within three business days of signing. The shop keeps the original.
The Indiana Association of REALTORS homebuyer Q&A is the consumer page I send people to. It says the same thing in plainer English: touring a home and talking about how it fits your budget is representation. Casual conversation, general advice, and browsing listings are not.
REALTOR MLS rules sit on top of that. Before we can tour an MLS listing with you, including a virtual showing, we need a signed buyer representation agreement that also covers compensation. Compensation is always negotiable. Indiana does not set the fee. The MLS does not set the fee.

What you actually sign at 112 S. Main
You are not signing a promise to buy a bungalow on Court Street this Saturday. You are naming who represents you, what we will do, how long that lasts, and how we get paid if you close. We walk the form. We do not rush it at the curb.
Typical pieces, said once:
- Who we represent, and that you are a client, not a walk-in.
- A real end date. Indiana wants one. Open-ended is not the form.
- The work: search, showings, offers, inspections, closing help.
- Compensation, written as a number or a percent you agreed to, plus a line that it is negotiable and not set by law.
- Whether a seller or listing broker may still pay some or all of that off-MLS.
You get a copy. Keep it. If a term does not match what we said out loud, stop and fix it before we leave the office.
How we get paid now
The MLS no longer advertises what a listing broker will pay a buyer's broker. That is the national practice change. It does not mean nobody gets paid. It means the old auto-fill on the MLS is gone.
A seller can still offer to pay some or all of the buyer-broker compensation off the MLS. A listing can still say that in the flyer, in conversation, or in the purchase agreement. We write what you agreed to in your buyer agreement first. Then we see what the listing side is actually offering. If those two numbers do not match, we talk before you write the offer. Nobody should find that out at the closing table.
Illinois buyers who already have an Illinois agent: Indiana is a different license and a different MLS. We are licensed in both states. A Saturday in Crown Point, not a slogan

If the house you want is in Munster, we still need the Indiana agreement before we tour that MLS listing. The town changes. The paper does not.
What we will not do
We will not pretend a handshake is enough. We will not treat the agreement as a gag to keep you from looking at St. John or Munster. We will not quote a fee as if the state wrote it. We will not invent a legal answer on a form you have not seen. If the question is the statute, start with IAR. If the question is this house on this street, call the shop.

No. Browse realest.com/listing, the town pages, and this blog. The written agreement comes before we represent you and before we tour an MLS home with you.

Does this lock me into buying a house this week?
No. It names the relationship, the end date, the work, and how we get paid if you close. Read the expiration date out loud before you sign.
Who pays the buyer broker now?
It is negotiable and written in your agreement. The MLS no longer advertises that pay. A seller may still offer some or all of it off-MLS. We reconcile those two numbers before you write the offer.
I already have an Illinois agent. Do I still sign in Indiana?
